Enforcemenet and Non-enforcement Recovery of Maintenance Payments Jakub Troka, Department of Civil Procedure, Faculty of Law and Administration, Nicolaus Copernicus University in Toruń, Poland; ORCID 0009-0002-6479-5722 This academic article discusses the specific rules governing the enforcement and non-enforcement recovery of maintenance payments within the Polish legal system. The starting point for these considerations is the emphasis on the constitutional protection of the family and the child, which justifies the privileged procedural position of the maintenance creditor. The article explains the concepts of maintenance and maintenance-type payments. Particular attention is paid to the privileged position of the maintenance creditor – including the extension of their powers regarding the selection of the bailiff competent for maintenance payments and the reduction of formal requirements for the application for enforcement. The author notes that the enforcement of maintenance payments is also characterised by an increased scope of enforcement in the case of specific enforcement methods. The article addresses the role of the court in maintenance enforcement cases and highlights non-enforcement methods of satisfying such claims. The aim of the research cited is to demonstrate the systemic prioritisation of maintenance payments as benefits of an existential nature.
