Foreign exchange contracts have been at the center of public and legal attention since 2008. Over the past nearly eighteen years, there have been numerous shifts in how they are viewed, shaped not only by domestic legal practice - which was initially inconsistent - but also by the decisions of the Court of Justice of the European Union. Looking back at the history of foreign currency litigation, it is clear that, in the absence of legislative intervention, the application of the law proceeded step by step, with the resolution of one issue giving rise to further problems in the application of the law. With its decision in Case C-630/23, the Court of Justice of the European Union (hereinafter: CJEU, the Court) seemed to finally bring the practice regarding foreign currency litigation to a stable point; however, the CJEU's judgment in Case C-679/24, the Hungarian Supreme Court's uniformity of law proceeding No. Jpe.60.009/2026, and Act XVI. of 2026 have once again brought the issue of foreign currency contracts to the forefront. The purpose of this study is to review the latest challenges in foreign currency litigation, along with a brief overview of the path that has led to this point.
