This article examines the place, role, and functional features of intellectual property dispute resolution in international commercial arbitration. It describes theoretical and methodological approaches to the concept of “international commercial arbitration” as an alternative method for resolving intellectual property disputes. The concept of “arbitrability” is analyzed in relation to intellectual property disputes. The specific content of intellectual property rights, which has a significant public law component, is identified. A position is formulated regarding the arbitrability of intellectual property disputes over unregistered intellectual property and the ineligibility of disputes over registered intellectual property.
