Abstract
The article attempts to present the key questions the legislator had to answer when preparing the new insolvency law. The significance of the insolvency law system in the broader sense goes beyond the rules of procedures for the enforcement of the interests of creditors of insolvent debtors: the provisions of the insolvency law fundamentally influence the operation, stability and competitiveness of a modern market economy. The traditions of Hungarian bankruptcy law oblige us to restore the broken legal continuity with the Apáthy Code, which can be considered the foundation of insolvency law, by adopting a new code that is the cornerstone of the insolvency system and thereby reinstate the insolvency law to its former status.
