تناولَ البحثُ المسؤوليةَ المدنيّةَ عن الضررِ البيئيّ في ظلِّ المسؤوليةِ المدنيّة، ومدى قصورِ عناصرِ المسؤوليةِ التقصيريّةِ والمسؤوليةِ العقديّةِ بصورتِها التقليديّةِ في استيعابِها كأساسٍ للمسؤوليةِ المدنيّةِ عن الضررِ البيئيّ، ممّا دفعَ الفقهَ إلى البحثِ عن أُسُسٍ أُخرى حديثةٍ يمكنُ من خلالها التعويضُ عن الضررِ البيئيّ. ومن أهمِّ تلك الصور: نظريّةُ مضارِّ الجوارِ غيرِ المألوفة، ونظريّةُ تحمُّلِ التبعة. كما أوضحَ البحثُ الأساسَ القانونيَّ الذي اتخذه المشرِّعُ العراقيُّ أساسًا للمسؤوليةِ المدنيّةِ عن الضررِ البيئيّ، وهو الخطأُ المُفترض، وخيرُ ما فعلَ المشرِّعُ العراقيُّ في قانونِ حمايةِ البيئةِ العراقيّ. لكنْ هناك صورًا لا يمكنُ لهذا الأساسِ استيعابُها، كما لا يمكنُ استيعابُها من خلالِ الأُسُسِ التقليديّةِ التي ينصُّ عليها القانونُ المدنيُّ العراقيّ.
