Abstract
Abstract
Divorce constitutes one of the fundamental legal institutions of family law, whose regulation and evolution respond to social and legal transformations related to the dissolution of the marital bond. This paper addresses the historical and regulatory development of divorce in Mexico, with particular attention to no-fault divorce and the incorporation of oral proceedings into family law procedures. It examines the evolution of this legal institution from its historical background to its contemporary implementation, as well as the elimination of the requirement to establish specific grounds for seeking the dissolution of marriage. Likewise, the different procedural avenues and the characteristics of oral proceedings in family law are analyzed, particularly the principles of immediacy, concentration, simplicity, and promptness. The study considers the implementation of summary oral proceedings in the State of Puebla and the provisions related to civil and family proceedings. The analysis recognizes no-fault divorce as a mechanism aimed at expediting the dissolution of the marital bond while ensuring the legal protection of spouses, children, and other interests arising from family relationships. In this context, oral proceedings are presented as a relevant component in promoting more efficient family law procedures and a more expeditious and effective administration of justice.
