Abstract

Abstract

The Commercial Courts Act, 2015 represents a significant reform in India’s commercial dispute resolution framework, aimed at ensuring speedy, efficient and specialised adjudication of commercial disputes. The Act introduced a dedicated institutional structure comprising Commercial Courts, Commercial Divisions and Commercial Appellate Divisions, supported by specialised procedural mechanisms. This paper examines the institutional and procedural reforms introduced under the Act and evaluates their effectiveness in improving the efficiency and predictability of commercial adjudication. The study adopts a doctrinal and analytical methodology based on statutory provisions, judicial decisions, Law Commission reports and secondary sources. It identifies continuing challenges including judicial vacancies, infrastructure deficiencies, pendency and inconsistent implementation, and suggests measures to strengthen the commercial justice system.
