This multidisciplinary study focuses on labor law, positing that—alongside other factors—precarious employment conditions may be a contributing cause of the forest fires that ravage the country year after year. After reviewing applicable legislation and Supreme Court case law, the research examines the fire management organizational structures across the autonomous communities. This reveals diverse models, yet in the majority of cases, the employer is a public entity—specifically an “instrumental body” of the Public Administration—with employment governed by labor law; such employers are typically TRAGSA or similar companies. This practice runs counter to legal norms, as the use of instrumental bodies by the Public Administration is intended to be an exception. In light of this, the study proposes a reallocation of competencies and the enactment of a unified law on emergency prevention.
