Abstract
Abstract
Catalogue of Disciplinary Offences Committed by Court Bailiffs dr hab. Joanna Bodio, professor at the Maria Curie-Skłodowska University in Lublin, Department of Civil Procedure and International Commercial Law, Faculty of Law and Administration, Maria Curie-Skłodowska University in Lublin, Poland; ORCID: 0000-0003-0428-7267 As a representative of a profession of public trust, a bailiff bears a special type of disciplinary responsibility. The Act on Court Bailiffs defines a catalogue of disciplinary offences. The author, conducting a historical and legal analysis of the provisions concerning court bailiffs, supplemented by a formal and dogmatic method, answers the question of whether the list of disciplinary offences is open-ended or closed. This is important because of the difference of opinion on this issue in academia, which also has an impact on the practice of applying the law and disciplinary jurisprudence. Advocating for an open catalogue of disciplinary offences, the author indicates the types of behaviour (actions or omissions) that constitute individual disciplinary offences. Keywords: disciplinary liability of court bailiffs, disciplinary offences, disciplinary misconduct, catalogue of disciplinary offences, types of behaviour
