The Concept of the Condition of Immovable Property in Court and Enforcement Proceedings – Part II Andrzej Antkiewicz, judge of the District Court in Grudziądz, Poland; ORCID: 0009-0001-2496-1485 Przemysław Samełko, real estate appraiser and expert appointed by the Regional Court in Olsztyn, Poland; ORCID: 0009-0006-1554-2330 Agnieszka Zegarek-Dudzińska, real estate appraiser and expert appointed by the Regional Court in Szczecin, Poland; ORCID: 0009-0002-5311-4709 In the second part of the article, the authors discuss the concept of the status of immovable property in partition proceedings – concerning the division of jointly owned property and the termination of joint ownership – as well as in enforcement proceedings. These considerations are preceded by a discussion of the status of immovable property under the Act of 21 August 1997 on Real Estate Management, particularly following the reform of the spatial planning system, which altered the existing structure of sources of information on the designated use of immovable property by introducing general municipal plans as a new determinant in the property valuation process. An analysis of the legal provisions concerning the status of immovable property in the proceedings in question, court case law and specific practical examples – all discussed in detail in this study – has prompted the authors to draw conclusions of a cross-cutting nature.
