Abstract
This study examines the impact of an acquiring party’s abuse of a dominant position on competition protection. It considers how an acquisition may create or strengthen a dominant position and addresses the limits of its lawful exercise, the main forms of abuse, and the mechanisms for addressing anti-competitive practices. It also examines civil liability for the harm resulting from such practices under Lebanese law and selected comparative legislation. The study concludes that the mere existence of a dominant position does not constitute a violation; abuse arises when this position is used to prevent, restrict, or distort competition. It therefore calls for stronger oversight of the anti-competitive practices resulting from acquisitions, along with more effective legal mechanisms to prevent such practices and compensate for the resulting harm.
