Abstract

The commentary criticises two judgments, one of the Provincial Administrative Court in Olsztyn and the other of the Supreme Administrative Court, which denied the executive body of the commune the possibility of establishing a women’s council as a consultative and advisory body. First, the legal nature of the Women’s Council as an auxiliary body is described. Next, the legal basis invoked to date by executive bodies at all levels of local government for establishing women’s councils are analysed. The commentary primarily focuses on determining the possible legal basis for the establishment and the form of the legal act under which a women’s council would be established. The authors of the commentary agree that de lege lata there are provisions that are a sufficient legal basis for acts establishing such councils. The final section of the commentary presents the authors’ conclusions and discusses proposals for statutory changes concerning the establishment of women’s councils in local government units.
